Competition Terms and conditions

These terms and conditions together with any specific rules set out in Competition Notices (as defined below) are the Competition Rules (“Rules”) and apply to competitions on Oakley websites (“Competitions”) unless otherwise expressly stated. By entering a Competition, entrants agree to be bound by these Rules.

The Competition is organised by Oakley Icon Limited, Dublin/Ireland, Swiss Branch, Zurich, (hereafter "Oakley")

Eligibility

  • 1. Employees (or members of the families or households of employees) of Oakley or any company involved in the Competition, or any advertising agency or web company connected with the Competition or any such person’s subsidiary or associated companies, are not eligible to enter the Competition. Oakley reserves the right not to award a prize (and to select an alternative winner) if Oakley is aware or has reasonable grounds to believe that a winner is not eligible.
  • 2. Unless stated otherwise in the Competition Notice, Competitions are only open to residents of the United Kingdom, France, Germany, Italy and Spain and you are not entitled to enter the Competition if you are resident in a country of jurisdiction where the Competition may breach any law or regulation. Where this applies, Oakley’s invitation to enter the Competition in such country and/or jurisdiction is withdrawn.
  • 3. By entering the Competition, using the hashtag #changeperspective you hereby warrant that all information submitted by you is true, current and complete and Oakley assumes that by entering the Competition (and you warrant that) you are aged 18 or over or, if you are under 18, that your parents have consented to your entry into the Competition and these Rules. If a winner under the age of 18 is selected he/she must be accompanied by a parent or guardian if a prize involves travel/accommodation.
  • 4. Oakley reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of the Rules.
  • 5. In the event that any entrant is disqualified from the Competition Oakley in its sole discretion may decide whether a replacement should be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these Rules.

Competition Entries

  • 6. Unless stated otherwise in the Competition Notice you may enter the Competition as many times as you like however where a winner has been selected and Oakley discovers or has reasonable grounds to believe the winner has used any software or automated process to make bulk entries, Oakley may select an alternative winner. Any further winner will be selected on the same criteria as the original winner and will be subject to these Rules. Each photo and associated text or other materials are collectively considered one Entry
  • 7. The competition is open to individuals who submit original photos for consideration only. Please report any illegal or infringing content by sending an email to [marketinguk@oakley.com] with a link to the infringing content and a brief description of your concern.
  • 8. Competition entries must be made in the manner and by the closing date and time specified on the Competition Notice. Failure to do so will disqualify the entry.
  • 9. Entries can be submitted from 9am on 1st April 2013 (the “Opening Date”) and the closing date for Entries is 11.59pm on 30th June 2013 (the “Closing Date”). No Entries will be accepted before the Opening Date or after the Closing Date.
  • 10. There is no purchase requirement to enter a Competition and there is no charge to register for use of the website.
  • 11. Oakley cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of or unauthorised access to Entries, or Entries lost, damaged or delayed as a result of server functions, technical issues, virus, bugs or other causes outside Oakley’s control.
  • 12. In order to enter the Competition entrants must: post an image reflecting the theme ‘Change Perspective’ to the official Oakley Instagram account http://instagram.com/oakley or the official Oakley Twitter account https://twitter.com/oakley including the handle @Oakley and the hash tag, “#changeperspective”
  • 13. Prize winners will be chosen by a panel of appointed Oakley representatives from all submitted entries within 28 days of the closing date specified in the Competition Notice. In all matters, the decision of the judge(s) and Oakley shall be final and no correspondence or discussion shall be entered into.
  • 14. Prize winners will be notified on the Oakley.com/changeperspective website as well as via the platform they submitted from – either Twitter or Instagram.
  • 15. Return of any prize notification as undeliverable or failure to reply as specified in the notification and within 15 days may result in disqualification and selection of an alternate winner.
  • 16. Prizes are non-transferable and there is no cash alternative. Oakley reserves the right to substitute prizes of equal or greater value at any time.
  • 17. Prizes are awarded at Oakley’s discretion and no prizes will be awarded as a result of improper actions by or on behalf of any entrant. Where Entries are being judged on creative or artistic merit or other subjective criteria, Oakley and/or the Competition judges (acting reasonably) reserve the right not to select a winner, and/or to remove or amend selection criteria and/or the structure and operation of the Competition if Entries are not of the requisite standard.
  • 18. Where a prize may not be appropriate for a younger contestant the minimum age for entry will be stated in the competition notice and must be observed. Oakley reserves the right to request written proof of age of any winner.
  • 19. By submitting your photo to the Website (and as of the date above, via Instagram and Twitter), you hereby (i) agree and consent to Oakley Inc. and its affiliates, subsidiaries, and agencies (including advertising agencies) (the “Company”) using the submitted photograph(s) (collectively, the “User Content”) for marketing, promotion and other commercial and business purposes related to this advertising campaign, specifically, but not limited to, this Website and, with additional express written consent, a related limited-edition, print book to be published at a later time, and (ii) grant the Company, a perpetual, worldwide, non-transferable, royalty-free right and license to display, exhibit, transmit, reproduce, record, digitize, modify, alter, adapt, create derivative works, exploit the User Content in connection with the aforementioned purposes.
  • 20. Oakley does not guarantee to use or otherwise make available any Entry. Oakley may also, in appropriate circumstances, and at its sole discretion, reject, edit, remove or disable access to entries that appear to be legally or otherwise problematic e.g. infringe the copyright or other intellectual property of privacy rights of others, are defamatory etc. or fro any other reason.
  • 21. Your Entry and any information submitted by you must be personal to and relate specifically to you. You hereby warrant that your Entry and all information which you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party and will not contain anything that is libellous, defamatory, obscene, indecent, harassing or threatening. If relevant, Oakley reserves the tight, but not the obligation to screen, filter and/or monitor information provided by you and to edit, refuse to distribute or remove the same.
  • 22. This Competition is in no way sponsored, endorsed or administered by, or associated with Instagram or Twitter. Entrants are providing their information to Oakley UK and not to Instagram or Twitter.
  • 23. This competition uses the Instagram™ API and is not endorsed or certified by Instagram. In providing this website, Company abides by the Instagram™ Terms of Use, Privacy Policy, and API Terms of Use.

Liability

  • 24. Oakley reserves the right to cancel or amend the Competition or the Rules without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside Oakley’s reasonable control. Any changes will be posted either within these terms and conditions or the Competition Notice.
  • 25. In the event of any dispute regarding the Rules, conduct, results and all other matters relating to a Competition, the decision of Oakley shall be final and no correspondence or discussion shall be entered into.
  • 26. To the maximum extent permitted by law, Oakley and its related entities shall not be liable for any claims or actions of any kind whatsoever for damages or losses to persons or property which may be sustained in connection with receipt, ownership and/or use of the Prize.
  • 27. Oakley cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Competition or as a result of accepting any prize. Oakley is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment or software, failure of any email or entry to be received on account of technical problems of traffic congestion on the Internet, telephone lines or at any web site, or any combination of these, including any injury or damage to entrant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in the Competition. Nothing shall exclude Oakley’s liability for death or personal injury as a result of its negligence.

Data Protection and Publicity

  • 28. Winners may be requested to take part in promotional activity and Oakley reserves the right to use the names and addresses of winners, their photographs and/or visual recordings of them in any publicity.
  • 29. Any personal data relating to entrants will be used solely in accordance with current European Union data protection legislation and will not be disclosed to a third party without the individual’s prior consent. Please see Oakley’s privacy policy for further details. Data relating to entrants will be retained by Oakley for a reasonable period after the Competition closes to assist Oakley to operate competitions in a consistent manner and to deal with any queries on the Competition.
  • 30. If you have separately agreed to receive communications from Oakley UK or a third party, then your personal data may be used by them for such purposes, including direct marketing.
  • 31. For residents of the European Union, you hereby affirmatively consent to the transfer of your personal information outside the European Union.

Jurisdiction

  • 32. The present Rules are governed by and construed according to Swiss law, excluding conflict of law rules and international treaties. Any dispute which might arise with Oakley out of or in connection with the Competition will be subject to the exclusive jurisdiction of the courts of Zurich.
  • 33. These rules are drafted in the English Language. In the event of a discrepancy between any foreign language version and this version, then this English Version will govern.
